Welcome to toNikah. These Terms & Conditions (“Terms”) govern your access to and use of the toNikah website, web application, and Android/iOS mobile applications (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About toNikah

toNikah is a matrimonial matchmaking platform designed to help adult users connect for serious relationships and marriage. The Platform is strictly intended for matrimonial purposes and is not intended for casual dating, hookups, or social networking.

toNikah does not act as a marriage broker, agent, or guarantor. We provide a technology platform to facilitate user connections, and users independently decide whether and how to pursue relationships or marriage.

The Platform is operated by Web Hive UG (Germany) as the global operator. For users in India, payments are collected by Enumeration Technologies Pvt. Ltd. through authorized payment processors.

toNikah is a Muslim matrimonial platform. Membership is limited to adult Muslims, including those who embraced Islam (converts/reverts), seeking marriage in accordance with Islamic values.

2. Eligibility

  • You must be at least 18 years old to use the Platform.
  • Use by minors is strictly prohibited.
  • You must be Muslim to use the Platform. This includes individuals who embraced Islam (converts/reverts).
  • By creating an account, you confirm that you meet the eligibility requirements, including age and faith.

toNikah does not knowingly allow or support accounts created by individuals under 18.

Where a profile is managed with the assistance of a family member, the person seeking marriage must still meet all eligibility requirements.

3. Acceptance of Terms

By:

  • creating an account,
  • accessing the Platform, or
  • continuing to use the Platform after updates,

you acknowledge that you have read, understood, and accepted these Terms.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data. By using toNikah, you agree to the Privacy Policy, available at /privacy-policy.

4. Account Registration & Responsibilities

  • Each user may create only one personal account.
  • Accounts may not be sold, transferred, or assigned. A trusted family member may help manage a profile with the adult marriage seeker’s authorization, as described below. Both must protect account access and accurately identify the profile manager.
  • You agree to provide accurate, truthful, and up-to-date information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • Some users may manage a profile with the help of a trusted family member, such as a parent or sibling. The marriage seeker remains responsible for the accuracy of the profile and communications.
  • You must not register on behalf of anyone who does not meet the eligibility requirements.
  • If you use a third-party login method, such as Google, your account remains subject to these Terms and all eligibility rules.

toNikah is not responsible for unauthorized access caused by your failure to secure your account.

5. Nature of the Service

  • toNikah provides a matchmaking platform only.
  • We do not guarantee matches, compatibility, engagement, or marriage.
  • All interactions are user-to-user.
  • toNikah does not conduct full background checks and does not guarantee the authenticity or behavior of users.
  • Messaging may begin through a message request that the recipient can accept or decline.
  • We may limit the number of simultaneous active conversations per account.

You agree that any decisions to interact or meet another user are made at your own discretion and risk.

Interactions on the Platform must remain respectful, lawful, and focused on matrimonial purposes.

6. User Conduct & Prohibited Activities

You agree not to:

  • Create fake, misleading, or impersonated profiles
  • Harass, abuse, threaten, or harm other users
  • Engage in scams, fraud, or financial exploitation
  • Share another person’s private or confidential information
  • Use bots, scraping tools, or automated systems
  • Use the Platform for purposes unrelated to matrimony
  • Violate applicable laws or regulations
  • Send unsolicited inappropriate images, voice notes, links, or other media
  • Circumvent blocks, reports, message requests, gallery privacy controls, or chat limits
  • Solicit money, gifts, investments, loans, or financial assistance from other users
  • Misrepresent your identity, marital status, religious practice, intentions, or relationship availability
  • Upload or publish nudity, sexual content, excessive intimate exposure, hateful, racist, discriminatory, threatening, abusive, illegal, or exploitative content
  • Place phone numbers, email addresses, social-media handles, external links, QR codes, spam, solicitation, or other contact details in public profile text or images
  • Upload profile images that do not clearly show a person, present someone else as the account holder, materially conflict with the profile, or depict, sexualize, exploit, or endanger minors

toNikah prohibits child sexual abuse and exploitation (CSAE), child sexual abuse material (CSAM), grooming, sextortion and trafficking. The service is for adults aged 18 and over. Report suspected violations through in-app reporting or support@tonikah.com; do not send illegal images by email. We investigate reports, restrict offending accounts, remove confirmed illegal content and report to the appropriate authorities where required by law. support@tonikah.com is the public child-safety contact.

7. User Content

Ownership

You retain ownership of the content you submit, including profile information, photos, and messages.

License to toNikah

By submitting content, you grant toNikah a limited, non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify, and distribute your content solely for operating and improving the Platform.

Content Moderation

  • We may remove or restrict content that violates these Terms or our policies.
  • Users may report content or behavior they believe violates the rules.
  • Deleted content may remain in backups for a limited period due to technical or legal reasons
  • AI checks of profile photos and Headline, Bio, Company and About Partner text require separate account-wide permission. Without it, new submitted content remains unpublished pending admin review. You can change this permission in Data & privacy; changes apply to future checks.
  • Automated or manual moderation may flag, hide, restrict, or reject content pending review. Where the product provides an appeal option, you may request review.
  • Moderation may include profile content, gallery photos, messages, shared media, and view-once or similar media features.
  • New or changed profile text and images may remain hidden from other users while automated checks or human review are pending.
  • Content identified as uncertain or potentially violating may be sent to authorized human moderators. Rejected text will not be published, and rejected images may be permanently removed from the profile and active image storage. Limited residual copies may remain temporarily in backups for technical or legal reasons.
  • Automated systems can make mistakes and moderation does not guarantee that every violation will be detected immediately. You may contact support to question a moderation decision.
  • Content moderation is a safety measure. It does not verify a user's identity or guarantee that profile information is authentic.

8. Verification & Safety

  • toNikah may offer optional verification badges.
  • Verification does not guarantee user safety or behavior.
  • We may review, investigate, or act on reports submitted by users.
  • We may cooperate with law enforcement where required by law or valid legal requests.
  • You may block or report other users. We may investigate reports and take action at our discretion.
  • Optional verification does not replace your own judgment when communicating with or meeting users offline.
  • Private gallery, reveal, and access-grant features are privacy tools, but they do not guarantee user safety or the future handling of content by another user.

Verification may include a selfie check against profile photos, an age check, or a code sent to a WhatsApp number. A badge means at least one supported check was completed, not that all three passed. Availability depends on membership and the supported product version. Phone verification confirms access to a number, not legal identity. No badge guarantees safety, intentions, or the accuracy of every profile detail.

9. Paid Services & Subscriptions

  • The Android/iOS launch provides free introductory access without a membership purchase. Optional paid services may be offered separately on the website or in a future release. Free access does not automatically become a paid subscription; any purchase requires your explicit agreement to the displayed price and terms.
  • Subscription plans may be monthly, yearly, or otherwise specified at purchase.
  • Subscriptions may auto-renew unless canceled before the renewal date.
  • Cancellation stops future billing but does not refund the current period.
  • Payments are processed by third-party providers (e.g., Stripe, Razorpay, PayPal).
  • No refunds are provided unless required by applicable law.
  • Referral rewards or promotional membership offers, if available, are subject to program rules shown in the product and may be changed or discontinued.
  • Membership requirements apply only to paid features where expressly offered. They do not restrict features included in the free introductory mobile release.

For purchases made through Apple App Store or Google Play, billing, renewal, cancellation, and applicable refunds are managed through that store under its terms and applicable law. Deleting a toNikah account does not by itself cancel a store subscription. Use the store’s subscription settings.

10. Suspension & Termination

toNikah may suspend or terminate your account if you:

  • violate these Terms,
  • engage in prohibited conduct,
  • misuse the Platform, or
  • pose a risk to other users or the Platform.
  • repeatedly or seriously violate our profile text, image, media, or content rules.

You may delete your account at any time. Termination may result in immediate loss of access.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

  • uninterrupted or error-free operation,
  • compatibility,
  • outcomes of interactions,
  • user behavior.

12. Limitation of Liability

To the maximum extent permitted by law:

  • toNikah is not liable for user conduct or content
  • toNikah is not responsible for offline meetings or interactions
  • toNikah is not liable for emotional distress, financial loss, or personal harm arising from user interactions

Our total liability shall not exceed the amount you paid to use the Platform in the preceding subscription period, or the minimum amount required by law.

13. Intellectual Property

All Platform content, design, software, trademarks, and branding are owned by or licensed to toNikah.

You may not copy, modify, distribute, or exploit any part of the Platform without prior written permission.

14. Changes to These Terms

We may update these Terms from time to time.Material changes will be communicated through the Platform or email.Continued use after updates constitutes acceptance.

15. Governing Law

These Terms are governed by:

  • German law for users outside India
  • Indian law for users in India

Disputes shall be handled by competent courts in accordance with applicable law.

16. Assignment

toNikah may assign or transfer these Terms in connection with a merger, acquisition, restructuring, or sale of assets. Users may not assign their rights.
