Welcome to toNikah. These Terms & Conditions (“Terms”) govern your access to and use of the toNikah website, web application, and Android/iOS mobile applications (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About toNikah

toNikah is a matrimonial matchmaking platform designed to help adult users connect for serious relationships and marriage. The Platform is strictly intended for matrimonial purposes and is not intended for casual dating, hookups, or social networking.

toNikah does not act as a marriage broker, agent, or guarantor. We provide a technology platform to facilitate user connections, and users independently decide whether and how to pursue relationships or marriage.

The Platform is operated by Web Hive UG (Germany) as the global operator. For users in India, payments are collected by Enumeration Technologies Pvt. Ltd. through authorized payment processors.

2. Eligibility
  • You must be at least 18 years old to use the Platform.
  • Use by minors is strictly prohibited.
  • By creating an account, you confirm that you meet the age requirement.

toNikah does not knowingly allow or support accounts created by individuals under 18.

3. Acceptance of Terms

By:

  • creating an account,
  • accessing the Platform, or
  • continuing to use the Platform after updates,

you acknowledge that you have read, understood, and accepted these Terms.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data. By using toNikah, you agree to the Privacy Policy, available at /privacy-policy.

4. Account Registration & Responsibilities
  • Each user may create only one personal account.
  • Accounts are non-transferable and may not be sold, shared, or assigned.
  • You agree to provide accurate, truthful, and up-to-date information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.

toNikah is not responsible for unauthorized access caused by your failure to secure your account.

5. Nature of the Service
  • toNikah provides a matchmaking platform only.
  • We do not guarantee matches, compatibility, engagement, or marriage.
  • All interactions are user-to-user.
  • toNikah does not conduct full background checks and does not guarantee the authenticity or behavior of users.

You agree that any decisions to interact or meet another user are made at your own discretion and risk.

6. User Conduct & Prohibited Activities

You agree not to:

  • Create fake, misleading, or impersonated profiles
  • Harass, abuse, threaten, or harm other users
  • Engage in scams, fraud, or financial exploitation
  • Share another person’s private or confidential information
  • Use bots, scraping tools, or automated systems
  • Use the Platform for purposes unrelated to matrimony
  • Violate applicable laws or regulations

toNikah reserves the right to investigate and take action against violations.

7. User Content

Ownership

You retain ownership of the content you submit, including profile information, photos, and messages.

License to toNikah

By submitting content, you grant toNikah a limited, non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify, and distribute your content solely for operating and improving the Platform.

Content Moderation

  • We may remove or restrict content that violates these Terms or our policies.
  • Users may report content or behavior they believe violates the rules.
  • Deleted content may remain in backups for a limited period due to technical or legal reasons
8. Verification & Safety
  • toNikah may offer optional verification badges.
  • Verification does not guarantee user safety or behavior.
  • We may review, investigate, or act on reports submitted by users.
  • We may cooperate with law enforcement where required by law or valid legal requests.
9. Paid Services & Subscriptions
  • toNikah operates on a paid-only model.
  • Subscription plans may be monthly, yearly, or otherwise specified at purchase.
  • Subscriptions may auto-renew unless canceled before the renewal date.
  • Cancellation stops future billing but does not refund the current period.
  • Payments are processed by third-party providers (e.g., Stripe, Razorpay, PayPal).
  • No refunds are provided unless required by applicable law.
10. Suspension & Termination

toNikah may suspend or terminate your account if you:

  • violate these Terms,
  • engage in prohibited conduct,
  • misuse the Platform, or
  • pose a risk to other users or the Platform.

You may delete your account at any time. Termination may result in immediate loss of access.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

  • uninterrupted or error-free operation,
  • compatibility,
  • outcomes of interactions,
  • user behavior.
12. Limitation of Liability

To the maximum extent permitted by law:

  • toNikah is not liable for user conduct or content
  • toNikah is not responsible for offline meetings or interactions
  • toNikah is not liable for emotional distress, financial loss, or personal harm arising from user interactions

Our total liability shall not exceed the amount you paid to use the Platform in the preceding subscription period, or the minimum amount required by law.

13. Intellectual Property

All Platform content, design, software, trademarks, and branding are owned by or licensed to toNikah.

You may not copy, modify, distribute, or exploit any part of the Platform without prior written permission.

14. Changes to These Terms

We may update these Terms from time to time.
Material changes will be communicated through the Platform or email.
Continued use after updates constitutes acceptance.

15. Governing Law

These Terms are governed by:

  • German law for users outside India
  • Indian law for users in India

Disputes shall be handled by competent courts in accordance with applicable law.

16. Assignment

toNikah may assign or transfer these Terms in connection with a merger, acquisition, restructuring, or sale of assets. Users may not assign their rights.
